Dear Ms. Valean,

I am writing to you to request decisive actions to end the current situation at Barajas Airport in Madrid, and many others, where thousands of immigrants are arriving without the right to enter EU territory, ending up stranded at the airport facilities.

According to media outlets, the Spanish National Police is investigating the arrivals of illegal immigrants in flights from Casablanca with Royal Air Maroc.

If they take direct flights to Madrid, or any other Schengen airport, the Schengen Agreement in its Article 26 is clear, making the airlines responsible for these individuals and their eventual return. In this regard, it establishes that at the request of the border surveillance authorities the carrier shall be obliged to return the aliens to the third State from which they were transported, or to the third State which issued the travel document on which they travelled, or to any other third State to which they are certain to be admitted.

Moreover, it obliges the Contracting Parties to impose penalties on carriers which transport aliens who do not possess the necessary travel documents. Directive 2001/51/CE supplements these provisions, setting the obligation for airlines to bear all the costs when an immediate transportation is not possible, and minimum penalties for non-compliance.

To prevent these cases, I urge you to ensure that the Spanish Government is enforcing these laws, and using the Commission is right to initiative, to propose a black list for airlines who do not comply with the necessary checks on documentation or the obligations to return individuals, which shall complement the already established penalties. The proposed list can be a new one, or an amendment to the security based black list currently in force that prevents some carriers from flying to the EU.

Other cases, concern illegal immigrants purchasing flights with a stopover in EU Member States, with a destination in which they do not need visa, but refuse to board the following flight-requesting asylum instead.

For these cases, I urge you to expand the list of countries that need a transit visa to travel through the international transit areas of airports situated on the territory of the Member States, as set out in Annex IV to regulation (EC) No 810/2009 and to propose tighter conditions for their acquisition.
